By using Bully Pedex, including our website, platform, email services, SMS communications, or any affiliated service (collectively, "the Service"), you agree to the following Terms of Service ("TOU"). If you do not agree, you must immediately discontinue use of the Service.

1. Acceptance of Terms

Bully Pedex provides online resources, including classified listings, breeder directories, forums, catalogs, and subscription-based services. By accessing or using the Service, you agree to these TOU, any applicable guidelines, and any modifications Bully Pedex posts from time to time.

2. Modifications

Bully Pedex may modify the TOU at any time, effective immediately upon posting. You are responsible for reviewing these terms regularly. Continued use of the Service constitutes acceptance of all modifications.

3. Eligibility

The Service is intended for professional breeders, sellers, collectors, and resellers. Bully Pedex may refuse access to users not meeting eligibility requirements at its sole discretion.

4. Content & Licensing

• Users are responsible for all content they post, email, or otherwise submit.
• By posting content, you grant Bully Pedex a perpetual, worldwide, non-exclusive, transferable, fully paid license to use, copy, display, modify, and distribute content in connection with the Service or promotion.
• Bully Pedex is not responsible for third-party content, including links to external sites. You use all content at your own risk.

5. Third-Party Services

You acknowledge that any transactions, communications, or agreements with other users or third-party services are solely between you and the other party. Bully Pedex is not liable for disputes, losses, or damages arising from third-party interactions.

Bully Pedex does not permit unauthorized 3rd parties to make pedigrees for members for a fee.

6. Copyright & Infringement

To report copyright or intellectual property infringement, email notice@bullypedex.com including:

• Description of infringing material
• Statement of good faith belief
• Contact information
• Declaration under penalty of perjury
• Physical or electronic signature

7. Privacy & Information Disclosure

Bully Pedex may collect and disclose user information including IP addresses, emails, timestamps, and account activity. Personal information is governed by Bully Pedex's Privacy Policy.

8. User Conduct

You may not post content that:

• Is unlawful, abusive, threatening, pornographic, harassing, defamatory, discriminatory, fraudulent, or spam
• Violates intellectual property rights
• Misleads or impersonates any person or entity
• Uses automated posting devices without permission
• Contains viruses, malware, or harmful code
• Violates federal, state, or local laws including equal employment opportunity laws

You may not:

• Harass, stalk, or collect data about other users
• Attempt unauthorized access or disrupt the Service
• Post duplicate content across categories
• Use automated means (spiders, robots, crawlers) to download data without permission

9. Posting Agents

Only Bully Pedex-approved Posting Agents may post on behalf of others. Unauthorized use of Posting Agents is prohibited and subject to liquidated damages.

10. Paid Postings & Subscriptions

Certain areas of the Service require paid subscriptions or postings:

• All subscription payments are non-refundable unless otherwise stated
• Memberships renew automatically unless canceled
• Billing occurs upfront for monthly or annual cycles
• Membership prices remain locked as long as the account is kept current

Stripe Integration: All transactions are processed through Stripe. By paying, you consent to recurring billing and agree to the non-refundable policy.

11. Digital Service Acknowledgment

By purchasing a subscription or paid service, you acknowledge that you are receiving immediate access to digital services and waive any right to dispute charges once access is granted. All sales are final.

12. Limitations on Service

Bully Pedex may establish limits on use of the Service, including maximum retention days for content, posting frequency, and file sizes. Bully Pedex reserves the right to modify or discontinue the Service at any time without notice or liability.

13. Access to the Service

Bully Pedex grants you a limited, revocable, nonexclusive license to access the Service for personal use. This license does not include collection, aggregation, copying, or use of data mining tools unless expressly permitted.

14. Termination

Bully Pedex may terminate or suspend your account at its sole discretion, including for violations of the TOU. Termination does not entitle you to a refund. All fees paid are non-refundable. Sections 4–7, 10–14, 16–20 survive termination.

15. Proprietary Rights

All content, logos, and trademarks on the Service are owned by Bully Pedex or its licensors. You may not reproduce, distribute, or exploit any portion without express written permission. The Service is protected by copyright laws and international treaties.

16. Disclaimer of Warranties

YOU AGREE THAT USE OF BULLY PEDEX AND THE SERVICE IS ENTIRELY AT YOUR OWN RISK. BULLY PEDEX AND THE SERVICE ARE PROVIDED "AS IS" OR "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW.

17. Limitations of Liability

UNDER NO CIRCUMSTANCES SHALL BULLY PEDEX BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES RESULTING FROM ANY ASPECT OF YOUR USE OF THE SERVICE. Bully Pedex's maximum liability is limited to $25 per dispute.

18. Indemnity

You agree to indemnify and hold Bully Pedex, its officers, subsidiaries, affiliates, successors, assigns, directors, agents, service providers, and employees harmless from any claim or demand, including reasonable attorney fees and court costs, arising from your use of the Service, violation of the TOU, or content submitted.

19. Dispute Resolution & Liquidated Damages

Users agree that any legal disputes arising from violations of the TOU are governed by Georgia law.

Liquidated damages may apply for TOU breaches:

• $1,000 per message for impersonation or sharing personal info without consent
• $25 per unsolicited email advertisement
• $100 per violation for improper postings or excess frequency
• $3,000 per day for unauthorized content aggregation or exploitation

Bully Pedex may also pursue injunctions, specific performance, or recover actual damages.

20. SMS Messaging Terms

Customers receive SMS notifications for account updates, reminders, and occasional promotions:

• Message & data rates may apply
• Opt-out at any time by replying STOP
• Must be 18+ or have parental consent
• Frequency varies based on account activity

21. Stripe & Payment Terms

All payments are processed via Stripe:

• Statement descriptors will appear as Bully Pedex.com or Bully Pedex Membership
• Customers must acknowledge recurring billing and no-refund policies before completing purchase
• Access logs, IP addresses, and account activity will be retained for dispute evidence
• Once access to digital services is granted, the transaction is considered complete and non-refundable

22. Brand & Content Agreement

If you post or represent products:

• You warrant you have rights to all content, including logos, images, and product information
• You grant Bully Pedex the right to display this content on affiliated websites, emails, and promotions
• Membership fees remain locked as long as the account is active and up-to-date
• Termination takes effect at the end of the billing cycle with no refund

23. Terms for Professionals & Consumers

Bully Pedex offers various online programs as a convenience to participating professionals and consumers. As a condition of use:

• Bully Pedex is not a party to professional agreements between members and consumers
• All warranties regarding professionals, consumers, and services are expressly disclaimed
• Liability for services or goods received through the platform is limited to $25 per dispute
• Use of programs is at your sole risk

25. General Provisions

This TOU constitutes the entire agreement between you and Bully Pedex. The failure of Bully Pedex to exercise any right under the TOU does not constitute a waiver. If any section is invalid, other provisions remain effective.

Claims must be filed within one (1) year from the cause of action or be forever barred.

26. Governing Law & Arbitration

The TOU is governed by the laws of the State of Georgia, USA. All disputes will be subject to binding arbitration in Georgia, USA, unless waived by Bully Pedex.
